Below-listed is a set of required documents:

  • Form A2 along with a declaration form: As per FEMA, required every time the money is sent overseas to declare the sum amount that is to be transferred. Your bank will file this on your behalf within the LRS filings. Stockal automatically fills this for you - all you need to do is, ensure that the information is appropriate, then download the filled-in form, sign and upload it back for your bank to file.

  • Bank KYC documents: PAN Card and proof of address.

Your investing (brokerage) account is opened with our partner platform, Stockal and in the US your account is held with clearing services firm DriveWealth - regulated by FINRA and SEC. Brokerage services are offered to overseas investors by a licensed carrying and self-clearing broker. DriveWealth is backed by Softbank Group and other leading venture capital firms in the ecosystem of financial services. The custody of your account, in turn, would be held by DriveWealth, one of their custodian partners. You can raise your query if you require more information regarding the custody of your account.

The US brokerage ecosystem recommends that every investor account should have insurance. DriveWealth, a member of the Securities Investor Protection Corporation (“SIPC”) currently protects the securities and cash in your Account up to USD500,000 of which USD250,000 may be in cash.

  • Please bear in mind that this USD500,000 is not applicable general losses in the stock market. SIPC says the following: SIPC covers the loss of cash and securities – such as stocks and bonds – held by a customer at a financially-troubled SIPC- member brokerage firm. The limit of SIPC protection is $500,000, which is inclusive of a $250,000 limit for cash. A non-U.S. citizen with an account at a brokerage firm that is a member of SIPC is treated the same as a resident or citizen of the United States with an account at a brokerage firm that is a member of SIPC.

  • SIPC does not protect against the decline in value of your securities. SIPC does not protect people who are sold worthless stocks and other securities. No claims against a broker for bad investment suggestions or for recommending inappropriate investments, are protected by SIPC.

  • At present, you can invest up to an amount of USD 250,000 annually in foreign stocks from India. This amount can change as subject to RBI guidelines. Currently, your investments in US securities are also governed by the same limit.

  • Overseas investments fall under clearly defined RBI guidelines. The Liberalized Remittance Scheme (LRS) takes hold of the remittance of money for overseas investments

  • As per the LRS, an Individual can remit up to USD 250,000 per financial year for investing in foreign equities done through an authorized dealer (generally, your bank). As stated under RBI policy, a PAN card is must to purchase shares in foreign countries.

No TDS (Tax Deduction at Source) is applicable for your stock market gains in the US. So when you make money and transfer it back to your Indian bank account, the broker in the US does not apply to any tax deduction on it. You will be required to pay Short- term Capital Gains Tax OR Long-term Capital Gains Tax in India, whatever is applicable. In case security is held for less than 12 months then Short-term Capital Gains apply.

  • A 25% TDS to be applicable only on your dividend earnings. This is when stocks in your investment portfolio give out dividends to their investors.

  • The US and India have a Double Taxation Avoidance Agreement (DTAA). This means that you are required to pay tax only once. For the TDS applied on your dividend earnings, you will get W-8BEN from DriveWealth. It can be used when you file your taxes in India to show that you have already paid taxes on this income. Whenever you want your money back, sell any of your investments by simply clicking on the “Withdraw” button on your Portfolio page or inside "My Account". You will be shown how much money is available for you to withdraw. This is the "cash" in your account - either uninvested money or generated from sales of securities, you previously owned. Just place a withdrawal request and the money will be transferred to your domestic bank account. It generally takes 2-3 business days for the money to reflect in your account.

A $35 fee associated with withdrawals is charged by the US bank, so the cash balance in your account should be at least $35 at the time you place the withdrawal request.
